DRAFT OF LAW THAT MODIFIES THE ARTICLE 23 OF THE CIVIL CODE TO STREAMLINE THE NATIONALITY CONCESSION FOR SEPHARDIES PEOPLE

The last 7th of February, the Council of Ministries from the Spanish Government approved the remission to the Parliament of a Draft of law that modifies the article 23 of the Civil Code. The aim is to facilitate and streamline the Spanish nationality concession to the Sephardi people that justify their condition and their special link to Spain.

This draft of law, represents a very important measure through which Spain wants to recognize the Sephardi legacy on its history and culture.

The new rule contemplates the possibility to grant the nationality by naturalization without the necessity to be living in Spain and renounce to their current nationality, being that point the most important new of the draft.

In fact, this process will be applied to the people that can prove their Sephardi origin and also, a special link with Spain, as mentioned before, with some testimonial documents. Will be considered very important the evidence given by the applicant, that belongs to the Sephardi community, either in Spain or in the original country. Also, is available to the interested person, several lists of surnames considered Sephardies. Can be consulted in the following link.

From the approval of the law, the time to present the applications will be limited, being two years from the validity of the law, being possible to be extended by the Counsel of Ministries decision. The applications should be presented in an official application form published together with the law.

The interested people that would be in process of naturalization could apply expressly their will to continue this application according to the new law. In that case they should present again the required documents. 

This draft of law should be approved by the Congress and Senate, parliament process that could take several months and during that can occurred some modifications. Those, interested to apply to this way the Spanish nationality should wait until the definitive approval to the law to in order to get the nationality with the new regulation.
